С учетом исторического опыта и современного видения рассматриваются актуальные вопросы вовлечения в трудовую деятельность наименее защищенных категорий работников-инвалидов, повышения их роли в процессе труда. Предлагается изменение некоторых конструкций Трудового кодекса РФ. Обосновывается необходимость включения в него главы, посвященной регулированию труда инвалидов, профилактике инвалидности. Решение этих вопросов должно осуществляться в тесной связи с обеспечением нормальных условий работы, исключением вредных для здоровья факторов. Несмотря на многоплановость мероприятий по охране труда, в ст. 209 ТК РФ не учитываются природно-климатические условия той местности, где осуществляется трудовая деятельность. С учетом передового отечественного и зарубежного опыта по обеспечению нормальных условий работы в ТК РФ следует включить требования охраны труда, связанные с созданием условий для работы и отдыха в чрезвычайных ситуациях. Taking into account the historical experience and modern vision the topical problems of labour participation of the least protected categories of disabled workers and increasing their role in the labor process are considered. It is proposed to change some of the structures of the Labour code of the Russian Federation (RF LC). The necessity of including the chapter regulating the work of disabled persons, and prevention of disability is proposed. These issues should be implemented in close connection with the provision of normal working conditions eliminating the harmful factors. Despite the diversity of activities on labor protection in Clause 209 of the Labour Code the climatic conditions of the territory where the work is performed are not taken into consideration. With the advanced domestic and foreign experience in ensuring normal working conditions the RF LC should include the Labour protection requirements associated with the creation of conditions for work and leisure in an emergency situation.
