В статье анализируются вопросы реализации конституционного права граждан на безопасные условия труда в трудовом законодательстве и подзаконных актах по аттестации производственных объектов и оценке профессиональных рисков. Акцентируется внимание на правовых коллизиях, связанных де-юре с аттестацией производственных объектов промышленного профиля, которая де-факто интерпретируется шире и включает аттестацию рабочих мест и других сегментов экономики. Кроме того, выявлена коллизия на межведомственном уровне (Министерства труда и социальной защиты населения РК и Министерства энергетики РК), связанная с различиями в подходах к однородным общественным отношениям по обеспечению безопасных условий труда. Автор обращается к доктринальным взглядам относительно глобальных проблем организации и совершенствования системы управления охраны труда (СУОТ) с учетом отраслевых особенностей организаций, предприятий, учреждений. Констатируется, что в зависимости от специфики и динамики развития отрасли экономики имеются схожие и отличительные черты, круг проблемных вопросов, препятствий для формирования полноценной системы бюджетирования расходов на СУОТ. На основании конструктивно-критического анализа ситуации сделан вывод о том, что действующая система СУОТ должна быть проактивной, человекоцентричной и нуждается в дальнейшем совершенствовании в части формирования механизма бюджетирования затрат как ключевого финансового инструмента, позволяющего достичь социального и экономического эффектов и выполнения международных стандартов, на что нацеливают также Концепция правовой политики РК до 2030 года и Концепция безопасного труда в РК до 2030 года. The article analyzes the implementation of the constitutional right of citizens to safe working conditions, labor legislation and bylaws on the certification of production facilities and the assessment of occupational risks. Attention is focused on legal conflicts related de jure to the certification of industrial production facilities, which is de facto interpreted more broadly and includes the certification of workplaces and other segments of the economy. In addition, a conflict has been identified at the interdepartmental level (the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan and the Ministry of Energy of the Republic of Kazakhstan) related to differences in approaches to homogeneous public relations to ensure safe working conditions. The author refers to doctrinal views on the global problems of organizing and improving the labor protection management system (LPMS), taking into account the industry specifics of organizations, enterprises, and institutions. It is stated that, depending on the specifics and dynamics of the development of the sector of the economy, there are similar and distinctive features, a range of problematic issues, obstacles to the formation of a full-fledged system of budgeting expenses for LPMS costs. Based on a constructive and critical analysis of the situation, it was concluded that the current LPMS system should be proactive, human-centered and needs to be further improved in terms of forming a cost budgeting mechanism as a key financial instrument that allows achieving social and economic effect on the one hand and meeting international standards , which is also aimed at by the Concept of the legal policy of the Republic of Kazakhstan until 2030 and the Concept of Safe Labor in the Republic of Kazakhstan until 2030.
