E-mail: l.smorchkova@mail.ru. Автор статьи предлагает рассмотреть альтернативную модель решения проблемы совершенствования законодательства Российской Федерации об административных правонарушениях. Результаты произведенного анализа подтверждают, что в условиях современного темпа развития общественных отношений федеральная кодификация всех составов административных правонарушений не вполне эффективна - создает перманентную нагрузку на законодателя, провоцирует избыточность и бессистемность правовых норм. Представляется возможным, во-первых, устанавливать административную ответственность в федеральных законах, имеющих специальный характер; во-вторых, позволить субъектам Российской Федерации дифференцированно устанавливать санкции за нарушение федеральных норм в случае наличия региональных особенностей и отсутствия соответствующих составов правонарушений в КоАП РФ. The author of the article suggests considering an alternative model for solving the problem of improving the legislation of the Russian Federation on administrative offenses. The results of the analysis confirm that in the current pace of development of public relations, the federal codification of all administrative offenses is not quite effective - it creates a permanent burden on the legislator, provokes redundancy and unsystematic legal norms. It seems possible, firstly, to establish administrative responsibility in federal laws of a special nature; secondly, to allow the constituent entities of the Russian Federation to differentially establish sanctions for violation of federal norms in the event of regional specificities and the absence of appropriate offenses in the Code of Administrative Offenses of the Russian Federation.
