Статья посвящена анализу необходимости существования института понятых в современном российском уголовном процессе в условиях постоянной информатизации общества и развития цифровых технологий, приведены отрицательные моменты практики применения данного института при производстве следственных действий. Соотнесено понимание института законодателем, теорией и правоохранительной практикой. В обоснование отказа от понятых представлена альтернатива данному институту в виде использования достижений информационных технологий – сферической фото/видеофиксации. The article is devoted to the analysis of the necessity of the existence of the institution of attesting witnesses in the modern Russian criminal process in the conditions of constant informatization of society and the development of digital technologies, the negative aspects of the practice of using this institution in the production of investigative actions are given. The understanding of the institution by the legislator, theory and law enforcement practice is correlated. To substantiate the refusal of attesting witnesses, an alternative to this institution is presented in the form of using the achievements of information technology - spherical photo/video recording.
