E-mail: aleksandra1810@mail.ru. Автор анализирует понятие «защитник» в уголовно-процессуальном законодательстве, высказывает предложение о необходимости расширение данного в законе определения. Кроме того, рассматриваются вопросы участия субсидиарных защитников при оказании подозреваемым (обвиняемым) юридической помощи в суде, а также возможность предусмотреть на законодательном уровне критерии, предъявляемые к субсидиарным защитникам в качестве основания к допуску участия в уголовном деле, с целью избегания процессуальных ошибок и ограничения права на защиту. The author analyzes the concept of "defender" in the criminal procedure legislation, makes a proposal on the need to expand the definition given in the law. In addition, the issues of the participation of subsidiary defenders in the provision of legal assistance to suspects (accused) in court are considered, as well as the possibility of providing at the legislative level the criteria for subsidiary defenders as a basis for admitting participation in a criminal case in order to avoid procedural errors and restrictions on the right to defense.
