Изучение административно-правового статуса Уполномоченного при Президенте Российской Федерации по правам ребенка и уполномоченных по правам ребенка в субъектах Российской Федерации с использованием метода сравнительного анализа законодательств Российской Федерации и Республики Казахстан обусловлено возможностью эффективной реализации зарубежного законотворческого опыта в процессе российского нормотворчества с целью совершенствования правового и организационного механизмов института уполномоченного по правам ребенка. В статье рассматриваются законодательная основа, регулирующая деятельность уполномоченных по правам ребенка, основы их правового положения, анализируются проблемы административно-правового статуса Уполномоченного при Президенте Российской Федерации по правам ребенка и уполномоченных по правам ребенка в субъектах Российской Федерации, предлагаются возможные варианты их решения. Авторы приходят к выводу о том, что сравнительный анализ выступает средством взаимного обогащения систем национального и международного законодательств в сфере защиты прав и законных интересов несовершеннолетних. The study of the administrative and legal status of the Children’s Rights Commissioner for the President of the Russian Federation and commissioners of the children’s rights in the constituents of the Russian Federation using the comparative analysis of the legislations of Russia and Kazakhstan is determined by the possibility of effective implementation of foreign legislative experience in the process of the Russian rule-making to improve legal and organizational mechanism of the children’s rights commissioner institution. The article discusses the legislative framework governing the activities of the Children’s Rights Commissioners, the basics of their legal status, analyzes the problems of the administrative-legal status of the Commissioner for the President of the Russian Federation for the Rights of Children and the Children’s Rights Commissioners in the constituent entities of the Russian Federation, suggests possible solutions. The author comes to the conclusion that the comparative analysis is a means of mutual enrichment of the systems of national and international legislation in the field of protection of the rights and legitimate interests of minors.
