В статье рассматриваются международно-правовые основы права потерпевшего на эффективное расследование, возможности реализации права потерпевшего на эффективное расследование по УПК РФ, а также механизм реализации права потерпевшего на эффективное расследование в решениях Конституционного Суда РФ. Исследуется вопрос о процессуальном статусе потерпевшего и моменте его приобретения как отправной точке для зашиты им своих прав. Обращается внимание на особенности обжалования действий и решений должностных лиц, осуществляющих уголовное преследование, потерпевшим от преступления в порядке ст. 125 УПК РФ как наиболее эффективного механизма защиты прав потерпевшего в уголовном судопроизводстве. The article examines the international legal foundations of the victim's right to an effective investigation, the possibility of exercising the victim's right to an effective investigation under the Criminal Procedure Code of the Russian Federation, as well as the mechanism for imple-menting the victim's right to an effective investigation in the decisions of the Constitutional Court of the Russian Federation. The question of the procedural status of the victim and the moment of his acquisition as a starting point for the protection of his rights is investigated. Attention is drawn to the specifics of appealing actions and decisions of officials conducting criminal prosecution to victims of a crime in accordance with art. 125 The Code of Criminal Procedure of the Russian Federation as the most effective mechanism for protecting the rights of the victim in criminal proceedings.
