Анализ новой договорной конструкции о привлечении инвестиций – соглашения о защите и поощрении капиталовложений привел к выводу о законодательной путанице и сложности при определении его содержания и правовой природы. Делается предположительный вывод об отнесении данного соглашения к новой договорной конструкции, аналогов которого в российском законодательстве нет, и о необходимости внесения изменений в Федеральный закон «О защите и поощрении капиталовложений в Российской Федерации». The analysis of the new contractual structure on attracting investments – the agree-ment on the protection and promotion of investments led to the conclusion of legislative confusion and complexity in determining its content and legal nature. A tentative conclu-sion is made about the attribution of this agreement to a new contractual structure, which has no analogues in Russian legislation, and about the need to amend the Federal Law "On the Protection and Promotion of Capital Investments in the Russian Federation".
