В статье рассматриваются особенности исполнения договорных обязательств субъектов предпринимательской деятельности применительно к периоду времени, признанному в мире как «пандемия коронавируса». Анализируются понятия «непреодолимая сила» (форс-мажор), «предпринимательский риск», правоприменительная практика по вопросу освобождения от ответственности за неисполнение либо ненадлежащее исполнение обязательств. На основе исследованных нормативных правовых актов, изданных в период пандемии, в статье сформулированы выводы о том, что эпидемия коронавируса, как форсмажор, применим не ко всем сферам предпринимательских отношений. Автор акцентирует на том, что в сложившейся обстановке понимание форс-мажора и предпринимательского риска смешивается, и это влечет за собой необходимость пересмотра критериев отнесения к форс-мажору того или иного обстоятельства. The article discusses the specifics of the performance of contractual obligations of business entities in relation to the period of time recognized in the world as the "coronavirus pandemic". The article analyzes the concepts of "force majeure", "business risk", and law enforcement practice on the issue of exemption from liability for non-performance or improper performance of obligations. Based on the studied normative legal acts issued during the pandemic, the article concludes that the coronavirus epidemic, as a force majeure, is not applicable to all spheres of business relations. The author emphasizes that in the current situation, the understanding of "force majeure" and "business risk" is mixed and this entails the need to review the criteria for attributing a particular circumstance to force majeure.
