Abstract

В статье рассматривается конституционное правосознание как целостное образование, обладающее внутренней, содержательной структурой, приводится обобщенная характеристика особенностей данного типа правосознания. Отмечается взаимосвязь конституционного правосознания и бинарной природы права, закрепленной в Конституции РФ (естественного и позитивного начала). Раскрываются следующие структурные компоненты конституционного правосознания: рационально-идеологические, социально-психологические, духовно-культурологические, политические. Автором делается вывод об особой, предопределяющей роли компонентов конституционного правосознания для специфического типа правового поведения – поведения конституционного. The article deals with the constitutional sense of justice as an integral entity with an internal, content structure, and a generalized characteristic of the features of this type of legal consciousness. The interrelation of the constitutional sense of justice and the binary nature of law, enshrined in the Russian Constitution (natural and positive principle) is noted. The following structural components of the constitutional sense of justice are revealed: rational-ideological, socio-psychological, spiritual-cultural, political. The author makes a conclusion about the special, predetermining role of the components of constitutional legal awareness for a specific type of legal behavior – constitutional behavior.
