Процесс согласия является краеугольным камнем отношений между пациентом и врачом. Этот сложный этап оказания медицинских услуг, представляющий проблему как для врача, так и для пациентов из-за взаимодействия множества различных факторов, включая этические и правовые соображения. Получение информированного добровольного согласия является необходимым условием оказания медицинских услуг организациями, расположенными на территории международного медицинского кластера. В данной статье рассматриваются законодательные и теоретические аспекты, касающиеся обязательных требований к форме и объему согласия пациента на получение медицинских услуг. Анализируется и сравнивается зарубежная и отечественная судебная практика споров между медицинскими организациями и пациентами. Дается оценка вопросам содержания предоставляемой информации, правового регулирования отношений всех участников процесса получения медицинских услуг. Автор приходит к выводу о том, что в правовом регулировании информационного обеспечения качества оказания медицинских услуг существуют некоторые пробелы. На основе проведенного исследования предлагается уточнить законодательные требования к информированному согласию с учетом оказываемых видов медицинской помощи. The consent process is the cornerstone of the relationship between the patient and the doctor. This is a difficult stage in the provision of medical services, which is a problem for both the doctor and patients due to the interaction of many different factors, including ethical and legal considerations. Obtaining informed voluntary consent is a prerequisite for the provision of medical services by organizations located in the international medical cluster. This article discusses the legislative and theoretical aspects regarding the mandatory requirements for the form and scope of patient consent to receive medical services. The foreign and domestic judicial practice of disputes between medical organizations and patients is analyzed and compared. An assessment is given to the content of the information provided, the legal regulation of the relations of all participants in the process of obtaining medical services. The author concludes that there are some gaps in the legal regulation of information support for the quality of medical services. Based on the study, it is proposed to clarify the legislative requirements for informed consent, taking into account the types of medical care provided.
