Abstract

The bachelor’s thesis “Establishment of Servitude by a Court judgment” analyses the essence of the institute of the servitude, outlining its historical origin and the development of the grounds for establishment of the servitude in Latvia. In the thesis special attention is paid to the analysis of compliance of the establishment of the servitude by court judgment with the rights of an individual to property and immunity of the property, by assessing the commensurability of restriction and possibilities of its admissibility. Additionally the bachelor’s thesis, on the basis of Latvian court practice and correlating it with the legal provisions of separate foreign countries and understanding of the commensurability of establishment of the servitude, sets and analyses the conditions or criteria, which should be complied with in any case when establishing the servitude through court. The bachelor’s thesis examines the possibilities of the court, when establishing the servitude through court, to adjudge the compensation obligation to the user of the servitude for incommensurate restriction of the title. Keywords – institute of the servitude, establishment of the servitude, commensurability of infringement of the title, criteria for establishment of the servitude by court judgment, compensation for the use of the servitude.

Bakalaura darbā “Servitūta nodibināšana tiesas ceļā” ir pētīta servitūta institūta būtība, aplūkojot tā vēsturisko izcelsmi un servitūta nodibināšanas pamatu attīstību Latvijā. Darbā īpaši analizēta servitūta nodibināšanas ar tiesas spriedumu atbilstība personas tiesībām uz īpašumu un īpašuma neaizskaramību, vērtējot ierobežojuma samērīgumu un tā pieļaujamības iespējas. Papildus tam bakalaura darbā, pamatojoties uz Latvijas tiesu praksi un sasaistot to ar atsevišķu ārvalstu tiesību normām un izpratni par servitūta nodibināšanas samērīgumu, darbā izvirzīti un analizēti nosacījumi jeb kritēriji, kuri katrā ziņā jāievēro, nodibinot servitūtu tiesas ceļā. Bakalaura darbā aplūkotas iespējas tiesai, nosakot servitūtu ar tiesas spriedumu, piespriest servitūta izlietotājam atlīdzināšanas pienākumu par nesamērīgu īpašumtiesību ierobežojumu.
