Tiesas paziņojuma nosūtīšana personai ārvalstīs

Abstract

The main aim of the Bachelor’s thesis “Sending of court notifications to a person abroad” is to analyse legal regulation of delivery and service of judicial documents to a person whose place of residence or location is abroad and to identify its application problems in Latvia. Author provides insight into the relevant legal regulation in Estonia and Lithuania, and suggests amendment proposals to the Civil Procedure Law of the Republic of Latvia. To achieve the main aim, author analyses legislative acts of Latvia, Estonia, Lithuania and the European Union, international agreements binding on Latvia, legal doctrine and case law of the European Court of Human Rights, the European Court of Justice, Constitutional Court, and the courts of general jurisdiction in Latvia. The thesis consists of introduction, three chapters and conclusions.

Bakalaura darba “Tiesas paziņojumu nosūtīšana personai ārvalstīs” mērķis ir noskaidrot tiesas paziņojumu nosūtīšanas personai ārvalstīs regulējuma īpatnības un piemērošanas problēmas Latvijā, sniedzot ieskatu par tiesas paziņojumu nosūtīšanas uz ārvalstīm regulējumu kaimiņvalstīs – Igaunijā un Lietuvā, kā arī sniegt priekšlikumus nepieciešamajiem grozījumiem LR Civilprocesa likumā. Lai sasniegtu darba mērķi, tiek analizēti Latvijas, Igaunijas, Lietuvas un Eiropas Savienības tiesību akti un starptautiski līgumi, tiesību doktrīna, kā arī Eiropas Cilvēktiesību tiesas, Eiropas Savienības Tiesas, Satversmes tiesas spriedumi un vispārējās jurisdikcijas tiesu prakse. Darbs sastāv no ievada, trim nodaļām un kopsavilkuma.
