Abstract

Метою статті є пошук методологічних підходів до розуміння оперативно-розшукових заходів, під час проведення яких заподіюється шкода, та опрацювання критеріїв класифікації. Звертається увага, що під час проведення оперативно-розшукових заходів можливе заподіяння правомірної шкоди об’єктам кримінально-правової охорони, включаючи осіб, відносно яких проводиться оперативно-розшуковий захід, та сторонніх (третіх) осіб. Обмеження прав і свобод людини, що мають місце під час здійснення оперативно-розшукових заходів, цілком зрозумілими є щодо осіб, відносно яких провадяться такі заходи, оскільки їх права обмежуються за законом, що ж стосується третіх осіб – підпадають під ознаки порушень прав людини. The purpose of the article is to find methodological approaches to understanding the operational and investigative measures, during which the damage is caused, and to develop classification criteria. Attention is drawn to the fact that during the search operations it is possible to cause lawful damage to the objects of criminal law protection, including persons against whom the search operation is carried out, and third parties (third parties). Restrictions on human rights and freedoms that occur during the implementation of operational and investigative measures are quite clear to persons against whom such measures are carried out, as their rights are limited by law, as for third parties - fall under the signs of human rights violations.
