Los delitos contra la intimidad y la protección de datos personales: la responsabilidad penal del personal de la universidad

Abstract

La universidad es un espacio por donde circula continúa y diariamente multitud de información personal: listados de estudiantes, datos relativos a la salud del alumno, expedientes personales, información personal contenida en investigaciones científicas, etc. En este sentido, existe un importante riesgo de que el personal de estas organizaciones pueda llevar a cabo diferentes conductas delictivas en relación a dos derechos fundamentales: por un lado, el de la intimidad y, por otro lado, el de la protección de datos de carácter personal. Este trabajo de investigación tiene por objeto examinar los requisitos típicos de cada una de las modalidades delictivas recogidas en el Código Penal Español en estos dos ámbitos, realizando para ello un análisis normativo, doctrinal y jurisprudencial. Se pretende con ello, finalmente, identificar cuáles podrían ser algunos de los comportamientos delictivos que, distintos trabajadores de una universidad, pudieran efectuar respecto a estas materias.

The university is a space where a multitude of personal information circulates continuously and daily: student listings, data related to student health, personal records, personal information contained in scientific research, etc. In this sense, the staff of a University can carry out different criminal behaviors in relation to two fundamental rights: on the one hand, that of privacy and, on the other hand, that of the protection of personal data. This research work aims to examine the typical requirements of each of the criminal modalities included in the Spanish Criminal Code in these two areas, carrying out a normative, doctrinal and jurisprudential analysis. Finally, it is intended to identify what could be some of the criminal behaviors that, different workers of a university, could carry out with respect to these matters.
