Abstract

Se considera “profesional” a la persona física que ejerce una profesión. La profesión consiste en una actividad de carácter intelectual, que se ejercerá en forma preferentemente autónoma, aunque esto último no resulta excluyente. El tema que se propone analizar, la responsabilidad civil por el daño causado en la atención del paciente, excede el de “mal praxis”, que consiste, “en la omisión por parte del médico de prestar apropiadamente los servicios a que está obligado en su relación profesional con el paciente, omisión que da por resultado cierto un perjuicio al mismo o en la falta de pericia y cuidados razonablemente necesarios en el diagnóstico, pronóstico y tratamiento de las enfermedades, con daño cierto para el paciente. Las cuestiones de índole jurídica que se suscitan en el ejercicio de la profesión médica constituyen una parte especial de la responsabilidad profesional y están, al igual que ésta, sometidos a los principios generales de la responsabilidad civil, que consiste en el deber de resarcir los daños ocasionados a otros por una conducta antijurídica.
