Дискусійні питання обмеження розміру пенсії працівникам прокуратури

Abstract

Розглянуто питання пенсійного забезпечення працівників прокуратури, наголошено, що набрання чинності новим Законом України «Про прокуратуру» не припиняє статусу пенсіонера, особа продовжує отримувати пенсію за вислугою років відповідно до Закону України «Про прокуратуру», тому ототожнювати перерахунок пенсії із призначенням пенсії безпідставно. При запровадженні нових умов пенсійного забезпечення дотримуватися розумного балансу між інтересами людини, суспільства та держави, дотримуватися принципу легітимних очікувань і вірно тлумачити норми законодавства
