Abstract

Modern Ceza Muhakemesi Hukuku'nun temel amacı, gerçeğin ortaya çıkarılması sırasında izlenecek yolun ayrıntılı biçimde ortaya konmasıdır. Bu işlemler sırasında insan hak ve özgürlüklerine müdahale edilmesi gerekebilecektir. İşte bu aşamada `kanunilik` ilkesi gereği, sadece kanunun sağladığı alanın içerisinde bu yollara başvurulabilecektir. Modern Ceza Muhakemesi Hukukunun insan hak ve özgürlükleri ile en az bağdaşan tedbiri şüphesiz insan özgürlüğünün kısıtlanması sonucunu doğuran tutuklama kurumudur. Çalışmamızın konusunu, Türk Ceza Muhakemesi Hukuku'ndaki koruma tedbirlerinden tutuklama oluşturmaktadır. Tutuklama konusunda temel kaynağımız ise Ceza Muhakemesi Kanunu'nun 100-108. maddeleridir.

The main aim of Modern Criminal Judgment Law is to produce a detailed way for revealing the truth. During this process, human rights and liberties may be needed to be intervened. At this stage, due to legality principle, these interventions may be done only within the area that law has provided. By all means, the least suiting precaution of Modern Criminal Judgment Law to the human rights and liberties is the notion of arresting. The subject of this study, the Turkish Criminal Procedure Law, the protection measures are to arrest. Our main sources for arresting are articles 100-108 of Criminal Judgment Legislation.
