Abstract

В статье рассматривается особенность освобождения от наказания как уголовно-правового института. Определено значение освобождения от наказания, приведены его признаки и отличие освобождения от уголовной ответственности, рассмотрены виды освобождения от уголовного наказания. В результате автором выявлено, что освобождение от уголовного наказания играет важную роль в борьбе с преступностью, тем не менее, при его применении важно тщательно изучать личные дела осужденных, поскольку практика показывает, что нередко лица, освобожденные от наказания, вновь совершали преступные деяния.
