Abstract

Статья посвящена дискуссионным аспектам оценки признаков состава незаконных получения и разглашения сведений, составляющих коммерческую, налоговую или банковскую тайну (ст. 183 УК РФ). Автор рассматривает доктринальные и практические предложения по квалификации данного преступления, различные варианты анализа отдельных признаков состава, исследует вопросы разграничения со смежными нормами.
