LEGAL PROBLEMS OF TRANSBOUNDARY INSOLVENCY AND NEGATIVE STATES OF "BANKRUPT TOURISM"

Abstract

The article analyzes the norms of private international law and the current Russian competition law relating to the specifics of cross-border insolvency (bankruptcy) procedures. The substantive and procedural aspects are considered, in particular, the problems of conflict binding for determining the jurisdiction, including on the basis of the design of the «center of main interests». After investigating law enforcement practice, the authors come to the conclusion that there is no uniform approach to the solution of this category of cases.

В статье анализируют нормы международного частного права и действующее российское конкурсное право, касающиеся особенностей процедур трансграничной несостоятельности (банкротства). Рассматриваются материально-правовые и процессуальные аспекты, в частности, проблемы коллизионной привязки для определения подсудности, в том числе на основе конструкции «центр основных интересов». Исследовав правоприменительную практику, авторы приходят к выводу об отсутствии единообразного подхода к решению такой категории дел.
