Практические аспекты применения правил lis alibi pendens в международном гражданском процессе

Abstract

Предметом исследования является порядок урегулирования ситуации, когда в производстве одновременно украинского и иностранного судов находится дело по спору между теми же сторонами, по тому же основанию и тому же предмету. На уровне внутреннего законодательства Украины основные правила по этому вопросу изложены в ст. 75 (ч. 2) ЗУ «О международном частном праве». Автор, на основании изучения отечественной судебной практики, делает выводы о том, что необходимыми предпосылками для применения указанной нормы является установление тождественности исков и юридической силы иностранного судебного решения. В статье также рассмотрена позиция судов Украины относительно того, кто из участников гражданского процесса должен доказывать либо опровергать факт наличия в иностранном суде открытого производства по тождественному иску.
