Institute of Citizenship in the definition of the concept of "national minority"

Abstract

The article examines the problem of defining the concept of a «national minority» in the light of the requirement that the relevant person should have the citizenship of the state of residence. The article examines key international legal documents, as well as establishes the approach currently worked out in the framework of international intergovernmental organizations of a universal and regional nature. It is noted that, despite the tendency to renounce the requirement of citizenship, many states are currently using this criterion, limiting the rights of persons who identify themselves with national minorities.

Статья рассматривает проблему определения понятия «национальное меньшинство» в свете требования о наличии у лица гражданства государства проживания. В этом контексте рассматриваются ключевые международно-правовые документы, а также устанавливается подход, выработанный в настоящее время в рамках деятельности международных межправительственных организаций универсального и регионального характера. Отмечается, что, несмотря на тенденцию отказа от требования гражданства, многие государства и в настоящее время используют данный критерий, ограничивая права лиц, относящих себя к национальным меньшинствам.
