The legal concept of foreign trade transactions in the law of the People''s Republic of China

Abstract

This article is devoted to a comprehensive analysis of the legal concept and regulation of foreign trade transactions in the law of the People's Republic of China. It also identifies the role and importance of foreign trade transactions. These transactions, with all the variety of their content, as a general rule, are carried out through the conclusion and execution of civil contracts, to which the citizens, organisations and firms of different countries are parties. Thus, the article provides a detailed analysis of the legal regulation of this sphere in China. The formation of Chinese legislation in the field of foreign trade relations took place in the context of certain periods of historical development. The history of development begins in 1949. It is from this moment that foreign trade begins to develop within the framework of the new state called China. The 1950s saw the development of a national economy, improving trade, increasing foreign trade. In subsequent periods, including the "big jump" and the cultural revolution, as well as reforms of openness, foreign trade continued to develop. It should be noted that in the practice of foreign trade relations, the majority of transactions are bilateral, i. e. contracts concluded in foreign economic relations between two contractors.

Настоящая статья посвящена комплексному анализу правового понятия и регулированию внешнеторговой сделки в праве КНР. Рассматриваются роль и значение внешнеторговых сделок. Данные сделки при всем многообразии их содержания, по общему правилу, осуществляются посредством заключения и исполнения гражданскоправовых договоров, участниками которых выступают граждане, организации и фирмы разных стран. Так, в рамках статьи проводится детальный анализ нормативно-правового регулирования законов КНР. Формирование китайского законодательства в области внешнеторговых отношений происходило в контексте определенных периодов исторического развития. История развития начинается в 1949 г., когда возникает государство КНР. Именно с данного момента начинает развиваться внешняя торговля уже в рамках нового государства. С 1950-х гг. происходит становление народного хозяйства, налаживается производство, увеличиваются темпы внешней торговли. В последующие периоды, включающие в себя «Большой скачок» и культурную революцию, а также реформы открытости, внешняя торговля продолжала развиваться. Необходимо отметить, что в практике внешнеторговых отношений основную долю составляют двусторонние сделки, т. е. договоры, заключенные во внешнеэкономических отношениях между двумя контрагентами.
