Abstract

The notariate is the unique instiktut which is functioning on border of private and public spheres, having the dual, dualistic nature. Thenotaryinthis model at the same time acts on the one hand as the upolnomochenkny representative of the state performing public functions in the form of the notarial actions (which are expressed in concrete result which the parties which have addressed the notary wanted to reach), with another - is an independent and impartial legal consultant of the parties, the defender of their rights, the representative of a free prokfessiya. The similar dualism allows to combine public and private interests in human rights and law-enforcement process

Нотариат является уникальным институтом, функционирующим на границе частной и публичной сфер, имеющим двойственную, дуалистическую природу. Нотариус в этой модели одновременно выступает с одной стороны, как уполномоченный представитель государства, выполняющий публично-правовые функции в форме нотариальных действий (выражающихся в конкретном результате, которого стороны, обратившиеся к нотариусу, хотели достигнуть), с другой - является независимым и беспристрастным юридическим консультантом сторон, защитником их прав, представителем свободной профессии. Подобный дуализм позволяет сочетать публичный и частные интересы в правозащитном и правоприменительном процессе
