FORMATION OF THE CONSTITUTIONAL MODEL OF THE RUSSIAN FEDERALISM AND ITS BASIC PRINCIPLES

Abstract

The federal relations in Russia and the status of territorial subjects of the Russian Federation are derivative not of their will, but of will of the multinational people that creates a basis for the absence of conflict, reduction of political ambitions of regional political elites, the involvements of all levels of the public power into process of the solution of national tasks. Cultural and historical traditions of the government centralized state form viable model of the cooperative federalism assuming not opposition, but constructive interaction of levels of the public power in Russia. Its legal basis is made by the objects of mutual competence of the federal center and territorial subjects of the Russian Federation opening opportunities for dialogue between various levels of the government.

Федеративные отношения в России и статус субъектов РФ производны не от их волеизъявления, а от волеизъявления многонационального народа, что создает основу для их бесконфликтности, редуцирования политических амбиций региональных политических элит, вовлеченности всех уровней публичной власти в процесс решения общенациональных задач. Культурно-исторические традиции централизованного государственной управления формируют в России жизнеспособную модель кооперативного федерализма, предполагающего не противостояние, а конструктивное взаимодействие уровней публичной власти. Его юридическую основу составляют предметы совместного ведения федерального центра и субъектов РФ, открывающие возможности для диалога между различными уровнями государственной власти.
