The role of procedural rules in the international air law

Abstract

The article analyzes the correlation between the material and procedural norms of international air law. The author examines the sources of procedural norms, reveals the difference in the specifics of the wording, depending on the type of international document. The role of procedural norms in the course of material realization is singled out separately. The article also gives examples of procedural norms in international aviation regulations. On these examples, the author shows how the fulfillment of material requirements is ensured by procedural ones.

В статье проведен анализ соотношения материальных и процессуальных норм международного воздушного права. Автор исследует источники процессуальных норм, выявляет разницу в конкретике формулировки в зависимости от типа международного документа. Отдельно выделяется роль процессуальных норм в ходе реализации материальных. Также в статье приведены примеры процессуальных норм в международных авиационных регламентах. На этих примерах автор показывает, как выполнение требований материальных норм обеспечивается за счет процессуальных.
