Abstract

Статья посвящена зарубежному опыту в сфере использования договорных форм недропользования при добыче нефти и газа и других полезных ископаемых. В работе представлен обзор и особенности истории возникновения соглашения о разделе продукции в Индонезии, а также рассматриваются иные особые договорные формы недропользования, применяемые в зарубежных странах, такие, как концессия, сервисный контракт и иранский нефтяной контракт. Статья содержит их сравнение, сопоставление и содержание, в том числе их отграничение друг от друга и характерные особенности, включая порядки расчетов по проектам. Обзорно представлены основные положения зарубежного законодательства в сфере предоставления недр в пользование и приведены позиции различных российских и зарубежных исследователей в вопросах истории возникновения, применения, содержания и особенностей той или иной формы отношений недропользования

The article is devoted to analysis of foreign applying experience of subsoil using contract forms for oil and gas and other minerals production. This work presents a review and the features of production sharing agreement appearing in Indonesia and also considers other special subsoil using contract forms which are used in different countries for example concession, service contract and Iranian petroleum contracts. The article contains comparisons and details of different subsoil using forms and differences between them including payment and royalty options for projects. There is a review of basic law rules in subsoil using and positions of Russian and foreign researches on history of appearing practice of using, details and features for one or another subsoil relations form
