The historical process of international legal activity of states on the demilitarization of the outer space

Abstract

The article deals with the question of the phased establishment of the right regime, which prohibits the use of outer space, the Moon and other celestial bodies for military purposes. The aim is to reveal how historically international space law has established a partial ban on the militarization of outer space and a fully demilitarized regime that operates against the Moon and other celestial bodies. Through the prism of different in both their subject and scope of legal mechanisms, to keep track of the current standards for ensuring the safety of space activities. Preventing the placement of weapons in outer space is seen as a key aspect of the peaceful coexistence of states. The states agreed that it is impossible to preserve space without weapons only by prohibition norms, that is why the creation of a political and legal atmosphere through the strengthening of confidence, openness, predictability and cooperation is a prerequisite for achieving the goal.

В статье рассматривается вопрос о поэтапном установлении правого режима, запрещающего использование космического пространства, Луны и других небесных тел в военных целях. Ставится цель выявить, как исторически в международном космическом праве были установлены частичный запрет на милитаризацию космического пространства и полностью демилитаризованный режим, который действует в отношении Луны и других небесных тел. Рассматриваются актуальные на сегодняшний день нормы по обеспечению безопасности космической деятельности. Предотвращение размещения оружия в космическом пространстве выступает как ключевой аспект мирного сосуществования государств. Представляется невозможным одними лишь нормами-запретами сохранить космос без оружия, именно поэтому создание государствами политической и правовой атмосферы посредством укрепления мер доверия, открытости, предсказуемости и сотрудничества является необходимым условием для достижения поставленной цели.
