Принципы процесса медиации

Abstract

В статье автором раскрывается понимание принципов процесса медиации. Главная цель автора сосредоточить свою теоретическую работу на основных критериях процесса медиации и не только в рамках России, но и Европы и США. Идея заключается в том, что в любой дискуссии, касающейся выбора формальных (судебных) и неформальных процедур мы должны принимать во внимание преимущества и недостатки каждого конкретного способа разрешения спора вне зависимости от того, формальный он или нет. В статье анализируются такие существенные процессуальные элементы проведения процедуры медиации как: добровольность, конфиденциальность, сотрудничество и равноправие сторон, беспристрастность и независимость медиатора, его нейтральность. Автор рассматривает и такие минимальные требования как информированность и «открытость к результату», ответственность.

In the article the author describes understanding of the principles of mediation. The main goal of this article is the commitment to concentrate theoretical focus on «basic criteria» of the mediation process, not only in the frame of Russia, but also in Europe and the U.S. The key idea is that in any discussion of «formal (legal) and informal procedures» we must take into account values and defects of alternative processes, be they formal or not. This article analyzes such essential procedural elements of the mediation procedure as voluntary character, confidentiality, cooperation and equality of the parties, impartiality and independence, neutrality of the mediator. The author also considers such minimum requirements as awareness and «openness to the result of» as well as responsibility.
