Pandemiczne prawo

Abstract

The text sketches the main processes relating to changes in the legal system in the era of the Covid-19 pandemic in Poland and their potential consequences, taking into account the historical perspective set by Roman law on the principles of lawmaking. It describes examples of blatant violations of the principles of the legal order, especially concerning law-making procedures, which were undertaken by the state authorities of Poland in the course of combating the COVID-19 pandemic. The author concludes that the law and its principles became one of the victims of the COVID-19 pandemic in Poland, and the law-making and application of the law during its successive waves was a pretext for further chaotic destruction of the legal order and the principles of the rule of law, continuing since autumn 2015. He demonstrates that the procedural safeguards for the regularity of the law-making process, developed since ancient Roman times, are treated by the current ruling camp as an obstacle to governance, points to its instrumental attitude towards the law and its lack of respect and understanding for the value of upholding the legal order. In his view, these practices find understanding or indulgence from a part of the domestic public opinion, which is related to the anti-legalistic nature of the Polish legal culture. A potential change in this respect may be derived from political changes as a consequence of demographic shifts: indeed, sociological research indicates that younger generations of Polish citizens are reluctant towards the political camp currently ruling Poland.

Tekst szkicuje główne trajektorie procesów odnoszących się do zmian prawa doby tej pandemii Covid-19 w Polsce i ich potencjalnych konsekwencji, z uwzględnieniem perspektywy historycznej wyznaczonej przez prawo rzymskie w zakresie zasad stanowienia prawa. Opisano w nim przykłady rażących naruszeń zasad porządku prawnego, w tym zwłaszcza dotyczących procedur stanowienia prawa, które były podejmowane przez władze państwowe RP przy okazji zwalczania pandemii COVID-19. Autor dochodzi do wniosku, że prawo i jego zasady stały się w Polsce jedną z ofiar pandemii COVID-19 a stanowienie i stosowanie prawa w trakcie kolejnych jej fal było pretekstem do dalszej chaotycznej destrukcji porządku prawnego i zasad państwa prawa, trwającej od jesieni 2015 roku. Dowodzi, że rozwijane od czasów starożytnego Rzymu proceduralne zabezpieczenia prawidłowości procesu stanowienia prawa są traktowane przez obóz rządzący jako przeszkoda w sprawowaniu rządów, wskazuje na jego instrumentalny stosunek do prawa i brak szacunku oraz zrozumienia dla wartości, jaką jest przestrzeganie porządku prawnego. W jego opinii praktyki te znajdują zrozumienie lub pobłażanie części krajowej opinii publicznej, co wiąże się z antylegalistycznym charakterem polskiej kultury prawnej. Potencjalna zmiana w tym zakresie może być pochodną zmian politycznych, będących konsekwencją zmian demograficznych: badania socjologiczne wskazują bowiem na niechęć młodszych generacji obywateli RP wobec rządów tzw. Zjednoczonej Prawicy.
