О свойствах доказательств в уголовном процессе

Abstract

Статья представляет собой результат проведенного исследования об оценке доказательствкак элемента процесса доказывания, состоящий в логической деятельности по определениюотносимости, допустимости, достоверности и достаточности доказательств. В статье изложеннаучно-теоретический анализ понятия оценки доказательств в уголовном процессе, а такжерезультаты сравнительно-правового изучения регламентации вопросов оценки доказательствв уголовно-процессуальном законодательстве некоторых зарубежных стран. Оценкадоказательств состоит из следующих признаков: относимость доказательств (их отношение кпредмету доказывания); допустимость доказательств (законность их получения); достоверностьдоказательств (истинность, отсутствие разумных сомнений); достаточность доказательств(способность совокупности доказательств обосновать решение). Суд, прокурор, следователь,дознаватель оценивают доказательства по внутреннему убеждению, основанному на совокупностиимеющихся в уголовном деле доказательств, руководствуясь при этом законом и совестью.Научно-методологическую основу составили законы Республики Казахстан, УК РК, УПК РК, атакже труды известных ученых-процессуалистов Казахстана и зарубежных стран.Ключевые слова: доказательство, процесс доказывания, субъект доказывания, оценкадоказательств, относимость, допустимость, доказательственное право.
