Abstract

A l’instar de toutes les mesures fiscales introduites par les États membres, la fiscalité nutritionnelle est contrainte par les règles issues du droit de l’Union européenne, notamment la réglementation relative aux aides d’État issue de l’article 107 TFUE. Si les objectifs non-budgétaires et non-économiques poursuivis par les États membres ne sauraient justifier leur exclusion du champ d’application de l’article 107 TFUE, la mise en oeuvre de cette disposition fait apparaître certaines spécificités. Les particularités de la fiscalité nutritionnelle (mais le constat est vrai pour tout type de fiscalité comportementale) conduisent ainsi à une adaptation des modalités de son contrôle au regard de la réglementation relative aux aides d’État.

As with all tax measures introduced by Member States, nutritional taxation is subject to the rules of European Union law, in particular the rules on state aid set out in Article 107 TFEU. While the non-budgetary and noneconomic objectives pursued by Member States cannot justify their exclusion from the scope of Article 107 TFEU, the implementation of this provision does reveal certain specificities. The particularities of nutritional taxation (but the same is true of all types of behavioral taxation) mean that the arrangements for monitoring it must be adapted in line with the rules on state aid.
