Abstract

Moreso se ha referido a «los intocables del derecho» para aludir –desde su original imagen del derecho– a cierto aspecto de la dimensión institucional de los sistemas jurídicos, por la que, precisamente debido a razones morales, algunas de sus decisiones institucionales no estarían sujetas a una lectura moral, ni ser directamente derrotadas por razones de carácter moral. El objetivo de este trabajo es esbozar la tesis de que Moreso acierta en plantear esta suerte de inmunidad institucional que clausura los sistemas a su permanente lectura moral, pero que ésta podría hallar no solo una mejor justificación sino ciertos matices, si estos «intocables institucionales» se complementasen con algunos «intocables morales» para el derecho –por así decirlo–, justificados en última instancia en una antropología algo más robusta pero no por ello incompatible con nuestros Estados Constitucionales de Derecho, y en una teoría de la acción moral humana que justifique la equidad no solo como un mecanismo o técnica, sino sobre todo como una virtud, tesis propias de la tradición aristotélica.
