Публікацію присвячено дослідженню проблем сбалансування публічно-правових та приватно-правових засад забезпечення будівельної діяльності з урахуванням глобальної конвергенції правових систем. Обґрунтовано доцільність впровадження інституту само­регулювання у сфері будівництва та введення обов'язкового страхування будівельної та архітектурної діяльності. Запропоновано механізм захисту суб'єктивних прав інвесторів, покупців об'єктів будівництва через нотаріальне посвідчення договору купівлі-продажу. A publication is sanctified to research of problems of balancing of publicly-legal and privately-legal frameworks of providing of building activity taking into account global convergence of the legal systems. Expediency of introduction of institute of self-regulation is reasonable in the field of building and introduction of obligatory insurance of building and architectural activity. The protection's mechanism of equitable rights to investors, customers of building objects through the notoriety certification of bargain and sale is offered.
