The presented article contains the results of the research of the problem of limitation of property rights of domestic fish farms. Based on the results of the analysis of the provisions of legal acts defining the rules for the use of special equipment in aquaculture, as well as law enforcement practice, the shortcomings of regulation in this area are highlighted. Attention is drawn to the fact that the identified regulatory gaps do not allow entrepreneurs to take full advantage of government support, including subsidies and preferential loans. It is emphasized that due to unreasonable restrictions on the choice of property in demand, aquaculture companies are in a less favourable position than other agricultural producers. Such conclusions are confirmed by court decisions, which reflect the results of consideration of disputes on the protection of property rights by economic entities. In conclusion, the author makes proposals on the necessity to exclude a number of property encumbrances from the relevant departmental acts.

Представленная статья содержит результаты исследования проблемы ограничения вещных прав отечественных рыбоводных хозяйств. По результатам анализа положений правовых актов, определяющих правила использования в аквакультуре специального оборудования, а также правоприменительной практики, отмечаются недочеты регулирования в этой сфере. Акцентируется внимание на то, что выявленные нормативные пробелы не позволяют предпринимателям в полной мере пользоваться государственной поддержкой, в том числе субсидиями и льготными кредитами. Подчеркивается, что субъекты аквакультуры из-за необоснованных ограничений в выборе востребованного имущества находятся в менее выгодном положении по сравнению с иными сельскохозяйственными производителями. Такие выводы подтверждаются судебными решениями, в которых отражены результаты рассмотрения споров о защите хозяйствующими субъектами вещных прав. В завершение автор вносит предложения о необходимости исключения из соответствующих ведомственных актов ряда имущественных обременений.
