¿Cuál es la verdadera metodología de los derechos humanos?

Abstract

Los derechos humanos configuran fenómenos jurídicos, políticos, sociales, económicos y culturales que se analizan desde diversas disciplinas, de modo que no hay un solo método para estudiarlos. Por el contrario, hay tantas aproximaciones y métodos como preguntas y objetivos de investigación haya desde cada una de las distintas disciplinas que analizan a los derechos humanos. En las siguientes páginas se desarrollan cuatro metodologías utilizadas: 1. la herramienta jurídica conocida como “desempaque de derechos”, que sirve para operacionalizar los derechos humanos; 2. el uso de modelos estadísticos para conocer las causas de las violaciones a los derechos humanos; 3. el análisis de redes para examinar las redes de macrocriminalidad como procesos de violaciones a los derechos humanos; y 4. las historias de vida para identificar patrones en la construcción de las identidades de las personas defensoras de derechos humanos. La selección de estos métodos resulta azarosa y no tiene ninguna pretensión de exhaustividad ni comparación, sino que simplemente representan ejemplos. Si bien la metodología es importante para construir conocimiento sistemático, los elementos centrales de cualquier investigación —en especial cuando se trata de derechos humanos— los constituyen los objetivos y la pregunta principal, que deberían tener como finalidad el efecto útil de los derechos.
