La protección jurídica al funcionario informante en la Unión Europea: un análisis del Estatuto de los Funcionarios y el régimen interno de Frontex

Abstract

Este trabajo analiza los mecanismos de protección jurídica para los funcionarios informantes dentro de las instituciones y agencias de la Unión Europea, con un enfoque especial en Frontex. Examina críticamente el Reglamento del Estatuto de los Funcionarios de la UE y sus disposiciones sobre protección a los informantes, contrastándolas con el marco de protección más amplio establecido por la Directiva 2019/1937. El análisis resalta la naturaleza fragmentada de las protecciones disponibles para los funcionarios de la UE en comparación con los marcos nacionales, subrayando sus lagunas legislativas y problemas de aplicación. Se presta especial atención a Frontex por su significativa relación con los derechos fundamentales y la transparencia, evaluando sus mecanismos internos y deficiencias sistémicas. Finalmente, este trabajo ofrece recomendaciones para armonizar estándares a nivel europeo, garantizando una protección eficaz, homogénea y equitativa para los funcionarios informantes.
