About Use of Phonograms of Oral Speech in Disclosure of the Frauds Made With Use of Mobile Means of Communication

Abstract

In this article the author considers the state of crime in the Russian Federation, taking into account the available official statistical data; distinguishes between the main types of crimes most prevalent at present; the article is based on a consideration of relevant issues by the law enforcement institutions of the Russian Federation of the phonograms of oral speech (sound traces), which are used in the disclosure of crimes, in particular, fraud committed through the use of mobile communication devices. Special attention is paid to the question of identification of the alleged offender, and other persons representing operational interest and possessing operational-relevant information. Consideration is given to the existing problems in the implementation of operative-search actions, in the course of which, in accordance with the current legislation it is possible to obtain samples of oral speech. The author also touched upon the problems arising in the implementation of the data obtained during the operational-investigative measures of materials, taking into account the existing law enforcement experience. The specific examples enable the author to analyze the admissibility of obtaining and using voice samples for crime detection, in particular in relation to fraud committed with the use of mobile communication.

Рассматривается состояние преступности в Российской Федерации, с учетом имеющихся официальных статистических данных выделяются основные виды преступлений, наиболее распространенных в настоящее время. Анализируются актуальные вопросы использования правоохранительными органами Российской Федерации фонограмм устной речи (звуковых следов), возникающих при раскрытии преступлений, в частности — мошенничеств, совершаемых с использованием мобильных средств связи. Уделяется внимание идентификации личности предполагаемого преступника, а также иных лиц, представляющих оперативный интерес, располагающих оперативно значимой информацией. Рассматривается существующая проблематика при осуществлении оперативно-разыскных мероприятий, в ходе проведения которых в соответствии с действующим законодательством возможно получение образцов устной речи. Затронуты проблемы, возникающие при реализации полученных в ходе проведения данных оперативно-разыскных мероприятий материалов с учетом имеющегося правоприменительного опыта; с приведением конкретных примеров анализируется допустимость получения и использования образцов голоса для раскрытия преступлений, в частности применительно к мошенничествам, совершаемым с использованием мобильных средств связи.
