Derechos humanos de migrantes en gestiones locales: un análisis articulado por el concepto de ‘justicia anormal’ y la planificación estratégica situacional

Abstract

Este trabajo ensambla dos propuestas teórico-metodológicas para analizar iniciativas de gobiernos locales sobre cuestiones migratorias: la planificación estratégica situacional y el modelo de análisis de la justicia con la categoría de justicia anormal. La puesta en práctica de este análisis se realiza a partir de la exposición de hallazgos de una investigación desarrollada en 2023 sobre gobiernos locales de Sudamérica que implementaron iniciativas de protección de derechos de migrantes, en relación con el Pacto Mundial para la Migración. Pese a que la política migratoria se establece en el nivel nacional, las gestiones subnacionales tienen espacio para accionar de manera innovadora en materia de migración y derechos humanos, haciendo uso de políticas sociales, dispositivos territoriales y la voluntad política expresada en prácticas institucionales. Así, también logran mitigar o contrarrestar requisitos excluyentes o criterios restrictivos de los gobiernos nacionales.
