Abstract

Para este debate, os editores convidados formularam questões acerca da nova lei, publicada em 20 de maio de 2015. Procuramos abordar diversos temas: (i) os avanços da nova legislação após 14 anos de experiência na regulamentação do acesso e repartição de benefícios; (ii) se a nova lei respeita os princípios dos acordos internacionais; (iii) se ela atende aos anseios e direitos das comunidades tradicionais; (iv) se a lei foi elaborada com a contribuição da sociedade; (v) se a lei facilita o desenvolvimento de pesquisas; e (vi) quais são as expectativas dos debatedores quanto a esse novo marco. O leitor perceberá que os posicionamentos acerca da lei n° 13.123 são divergentes quanto aos avanços e retrocessos representados por ela, especialmente no tocante à garantia dos direitos das comunidades à repartição de benefícios e à sua participação no processo de construção da lei. Dessa forma, o debate transcrito a seguir traz diferentes visões e argumentos para esclarecer os possíveis efeitos da recém-instituída regulamentação. Os debatedores dão ainda contribuições para o seu aprimoramento.
