Sistema penal e seletividade social

Abstract

O presente artigo científico tem como objetivo abordar a operacionalidade do subsistema penal, suas práticas e seus efeitos na sociedade, bem como as suas funções latentes, contrastando-as com a sua programação normativa teleológica que a (auto)legitima, embora em permanente crise, a partir de uma visão crítica, baseada, sobretudo, nos estudos da Criminologia Crítica. A partir disso, redefine-se o conceito corrente de criminalidade como seletividade, onde a regra é a impunidade/imunidade e a seleção a exceção no sistema penal, que se dá fundamentalmente com base nos estereótipos criminais, do autor e da vítima. Ao final, busca-se explicitar a função real do sistema penal como reprodução material e ideológica da desigualdade social, isto é, o sistema penal como instrumento a garantir a vigência do sistema capitalista patriarcal.
