Abstract

En Colombia, el procedimiento y límites a las reformas constitucionales han sido consagrados en la Constitución Política de 1991, cuya observancia no sólo corresponde a los órganos instituidos para tal fin, sino que, a su vez delimita la competencia de la Corte Constitucional de Colombia, Sentencia para el control de constitucionalidad de dichos actos. En ese orden, la competencia encargada a la Corte se limita a corroborar la observación del procedimiento señalado para cada acto reformatorio, quedándole prohibido conocer o pronunciarse sobre el contenido material de la reforma. Sin embargo, a partir del año 2003, la Corte Constitucional de Colombia, Sentencia ha establecido la línea jurisprudencial conocida como la teoría de la sustitución de la Constitución, como límite a las reformas constitucionales, que la faculta para decidir sobre la competencia de los órganos reformatorios, derivada de la interpretación hecha por esta a la Constitución, abriendo el debate de si, con dicha teoría, estaría la Corte violando los límites que le impone la propia Constitución.
