Do “peculiar interesse” ao “interesse local”

Abstract

O Município Brasileiro e seus interesses intrínsecos é o tema cerne do presente Trabalho, cujo plano de fundo está nas diversas conotações assumidas por tal instituto ao longo da História Constitucional de nosso País, as quais se encontram combinadas com o modelo de federalismo ora adotado. O ponto de partida de tal desenvolvimento reside nas municipalidades no Brasil Colônia e se estenderá até os dias atuais, contexto no qual o Município brasileiro, então parte da Estrutura Federalista, encontra-se vinculado a princípios como a Subsidiariedade. A partir desse ponto, observa-se a mudança de paradigma existente, ao constatar-se que o termo “peculiar interesse”, até então presente ao longo das Constituições anteriores, na condição de sinônimo de “assuntos peculiares”, passa a receber uma carga semântica diversa da até então tida, através do termo incorporado à redação do art. 30, I, da CRFB/88, o “interesse local”.
