HERMENEUTICA DE LA TEORIA DEL ABUSO DEL DERECHO

Abstract

Este trabajo se enmarca en un Proyecto de Investigación, dirigido por el Abogado y Contador Claudio A. Casadío Martínez, aprobado por Resolución 084/10 del Consejo Directivo de esta Facultad. Trato aquí, en forma sintética, de depurar el Instituto de la Teoría del Abuso del Derecho, dando claridad y transparencia a este dispositivo, utilizado a medias por los operadores del derecho, y muchas veces atacado por parte de la doctrina civilista. Analizo el mismo, desde su nacimiento, hasta la actualidad, en Argentina y en el derecho comparado, sin dejar de examinar también como lo ha aplicado nuestra jurisprudencia nacional en los casos más destacados. Además, incorporo en forma breve, el tratamiento que hace el Proyecto de Código Civil y Comercial 2012, presentado por la Honorable Comisión de Reformas, designada por el Poder Ejecutivo Nacional.
