Abstract

El impuesto de industria y comercio es un tributo territorial que recae sobre las actividades de servicios que se realizan directa o indirectamente en el territorio municipal, siendo la base gravable los ingresos brutos obtenidos en el año anterior. La actividad transportadora como actividad sujeta, es el conjunto de operaciones tendientes a trasladar personas o cosas de un lugar a otro, lo que la mayoría de las veces implica su ejecución en más de un municipio y la celebración de contratos de vinculación, pudiendo resultar gravado doblemente el mismo hecho económico. Sin embargo, la autonomía territorial en materia impositiva tiene su límite en la Constitución y la ley, en virtud del cual solo resulta posible gravar las actividades realizadas en la respectiva jurisdicción municipal por la empresa y el propietario del vehículo, teniendo como base los ingresos propios y estando vedado gravar el mismo hecho económico más de una vez.
