La autonomía de la voluntad en las relaciones afectivas de pareja

Abstract

Si existe una rama dentro del derecho privado en general y del civil en particular donde en mayor medida sus institutos ha sido considerados predominantemente de orden público, ha sido el derecho de familia, o –si se prefiere y en reconocimiento de las diversas formas familiares- de “las familias”. Fiel reflejo de ello, en los códigos decimonónicos –del que nuestro Código Civil de Vélez Sarsfield no fue la excepción- y aun tras sus sucesivas reformas, las normas del derecho de familia se encontraban fuera del alcance de la autonomía de la voluntad, y por tanto, de la posibilidad de las partes de autorregular sus relaciones. Pero la sociedad ha ido mutando, exigiendo el reconocimiento de “otras formas de vivir en familia”, generando un cambio de paradigma que se traduce en una tendencia hacia la “privacidad y/o autonomía”, y por tanto, a un retroceso del orden público, donde las cuestiones familiares son en definitiva más privadas que públicas. Sobre este punto de partida, nos interesa en esta oportunidad analizar la relación entre dichos principios en las relaciones afectivas de pareja, en el entendimiento de que en ambos se refleja con una prevalencia cada vez mayor de la autonomía de la voluntad.
