RESTRICCIONES AL DOMINIO, RELACIONES DE VECINDAD E INMISIONES INMATERIALES: UN RECORRIDO DESDE EL DERECHO ROMANO

Abstract

Si bien el dominio siempre ha sido concebido como el más amplio derecho que una persona puede tener sobre una cosa, también es cierto que ha reconocido limitaciones de distinta índole. El propósito de este ensayo es analizar el origen de estas restricciones en el Derecho Romano –y particularmente aquella vinculada a las inmisiones inmateriales en las relaciones de vecindad– así como estudiar la proyección de tales nociones romanas en el Derecho decimonónico francés, el Código Civil argentino y su Proyecto de Reforma del año 2012.
