Sistema penal e democraticidade

Abstract

O presente artigo tem como objetivo analisar criticamente a falta de democraticidade na produção de normas do sistema penal brasileiro. A problemática proposta intenta saber “quem são as pessoas que produzem as normas penais e o quão representativas da população elas são?”. A hipótese é a de que, apesar de iniciativas de correção de rumo, falta uma adequada representatividade na articulação de políticas públicas no sistema de controle e de punição. A partir do método qualitativo, por meio de uma abordagem hipotético-dedutiva, pretende-se demonstrar que há muito ainda a ser feito caso se queira que a normatização brasileira esteja no espectro do que se denomina ambiente democrático.
