Constitución uruguaya y “laicidad”

Abstract

Se propone un estudio sobre la laicidad en la Constitución uruguaya. Pese a que el término laicidad no se incluye en su articulado, se realiza una interpretación de las disposiciones que refieren a la neutralidad del Estado y de sus funcionarios en materia religiosa, ideológica, política, de creencias o de aspectos de conciencia en general. Se asume así un sentido amplio del concepto de laicidad -no el meramente alusivo a la materia religiosa- a efectos de contemplar las diferentes formulaciones constitucionales relacionadas bajo una necesaria consideración sistemática y teleológica. En ese sentido, se realiza fundamentalmente una interpretación del artículo 5 -sobre aconfesionalidad y neutralidad religiosa del Estado- y del artículo 58 de la Constitución -sobre servicio a la Nación, neutralidad y prohibición de proselitismo de los funcionarios, concibiendo como bases comunes de ambas disposiciones a la libertad y al deber estatal de igual consideración y respeto ante los distintos posicionamientos no nocivos de los individuos.
